Why do you think malpractice carriers ask if you sue clients for unpaid fees? B/c clients who get sued are far more likely to sue, grieve, or claim ineffective (or all 3). Is it really worth it? Consider turning the other cheek on unpaid fees.

Was talking with a scholar and they didn’t understand how sex offender registries could be applied retroactively, and when I explained that the courts have construed them as “not punishment” they were astonished. Everyone *but* the courts understands them as punishment.

Went to drinks last night with four other defense lawyers/former prosecutors. About 120 combined years of criminal practice. Not one of us could think of a time when talking to the cops helped someone avoid charges or where shutting up hurt them. Shut. Your. Mouth.

I tried a case this week against the best defense attorney team I’ve ever worked with. Contrary to popular belief, this is what prosecutors actually want: skilled, invested attorneys representing defendants. In fact, it’s a necessary factor for a properly functioning system.

If a jury instruction it is requested and denied, there’s almost no harm analysis. Jury charges are the best place for defense to get an appellate win. Plus a jury charge fight is fun and makes you look super smart!

Next trial - ask a seasoned witness on cross a Q which begins, “You would agree with me that _____” Watch as that W crams a terrible answer down your throat in front of the jury w/ a smile. Or maybe consider never asking a Q like that again in your career?!?

Does your county have it's own legislature? When bigwigs get together behind closed doors & decide "policies" isn't that what they're doing? "Judge, the law doesn't say you can do this?" "Counselor, It's our policy." Sounds like legislating, doesn't it?
