I have heard conflicting accounts just from the Obama side of things, but general sense is that Obama told Trump in their first Oval Office meeting after the election that Trump would be the US president who decides whether US can live with nuke-armed NKorea or...not.

"Sadly we'll be sued...and happily we'll win, I think." Not evincing much confidence. But arguably that's the point. The president can now position himself as the victim of an obstructionist, activist court that wants weak security and more crime. This fight could last until 2020

The president offered no legal defense or justification for his declaration of a national emergency. He anticipates being sued and the case ending up in the Supreme Court. "Hopefully we'll get a fair shake." So there's his legal and political strategy in a nutshell.
