The DRAMA of it all: the appellate court is saying, "Meh, we don't think you'll succeed on appeal but we'll hear you out anyways, and in the meantime, the election will proceed."

JUST IN: The 8th Circuit Court of Appeals declines request to hold off on election. "We do not think Kistner is likely to succeed on the merits of his contention that (MN law) as applied to the current situation, may coexist with the federal election laws."
