Jury selection is underway: 40/120 prospective jurors raised their hands when asked whether they felt they could not be impartial in this case. It was stunning. “Without hearing any evidence, you would find the defendant guilty?” Judge Burke asked one woman. “Yes.”

Judge Burke then read aloud a list of people who may take the stand at the trial or whose name might come up during testimony. Among the names read were Salma Hayek, Charlize Theron, Rosie Perez, Alyssa Milano, Miramax, and Cipriani Restaurant. More hands went up.

Update: Weinstein’s lawyers filed a motion today asking Judge Burke to recuse himself following his scathing admonishment yesterday.

The filing states that Burke was either suggesting that life in prison is an appropriate sanction for phone use in the courtroom or that “Mr. Weinstein is guilty, would surely be convicted, and that the (judge) already knew that (he) intended to sentence him to life in prison.”

Update: Judge Burke will not recuse himself. In court his morning he said his statements were not meant to be taken literally. “All I meant to do was scare him enough for him to discontinue using his phone.”

He truly believes himself to be above the law. He has got away with what he done for years including having it written into his contract he couldn't be sacked for sexual harrasement. His whole frail act is part of it as well. He isn't holed up at home, his life hasn't changed

His life has changed quite a bit. He went from everyone in Hollywood kissing up to him to everyone in Hollywood spitting on him. The point is...he hasn’t accepted that this is for real & forever.
