Thread 1). Scottish Justice minister says getting a GRC will not influence which prison a trans prisoner goes to. The MOJ also said the same during the UK consultation in 2018 but has since changed its stance based on legal advice. Who is right?

The policy itself provides for urgent action if a transman placed in male estate requests a move out. There is no mirror image provision for transwomen. It is not helpful here for govt not to acknowledge that the policy itself is asymmetric - and (once again) why that is.

But the fundamental point stands: such cases appear to be exceptional. In Scotland, only 1 of the 5 transmen prisoners reported in Dec 18 to be housed with men; more recent figures showed all being housed with women. An honest debate needs to acknowledge this - and why.

The Scottish Government's position relies on a different interpretation of the relevant case law from the Ministry of Justice in England and Wales and also appears to be at odds with the 2011 Prison Rules:

I've had my secret instructions about where to go for a meeting tonight of (mainly) women who want to discuss proposed legislation changes by the Scottish Gov. Why should women have to take such precautions for our safety over a legal meeting in 2020 to discuss women's rights?

13 MSPs from 4 political parties attended the meeting on women’s sex based rights at the Scottish Parliament this evening. That’s 10%. Thoughtful questions asked in good faith too. Wish we saw anything like comparable engagement in Westminster.
