I file a court claim to the same effect, but the court denies me the ability to have your accounts, and mine, financially audited (by a third party), because the court believes that my only motivation is to get my money back. You can use most any scenario, I assume.

Let’s assume, for a moment, that: I believe you have stolen monies from my accounts. I did not see you do this, but circumstantial evidence shows you spending monies at the same time as my monies have gone missing. Your contention is that it is your money that you are spending.

I do not know which party is correct, but it seems that the burden on the plaintiff is to prove his case by presenting evidence that he is barred from gathering. We went through this in the 1994 Gubernatorial race in Maryland.

Serious question(I am not a Solicitor/Lawyer): If I believe that you have stolen something, but you believe I am attempting to steal it from you, how do I attempt redress, through the court, if no court will entertain my request for access to the evidence to prove my allegation?

It is a little difficult to prove your case in court, when those courts refuse to hear your case because it hasn’t been proven in court. I have no idea of the merit of the allegations here, it just seems wrong to adjudicate before allowing evidence to be gathered.
