The Election Committee can have the right to declare the position vacant. However once the position has been declared vacant, the vacancy will have to go back to the date of nomination cause was not eligible to begin with

This is a real nexus between ABVP & DU. president Ankiv Baisoya asked to step down, suspended from ABVP just after crossing 2 months from elections after the deadline of reelection is over. Now come to the real question. When BJP is expelling Modi for the same reason?

Question is of legal principle: when a position falls vacant because of ineligibility cannot be left to the whim of the institutional head. Ankiv Baisoya has not *become* ineligible, he was ineligible to begin with and the disqualification should go to the date of scrutiny

election result declared on Sep 14. Verification of fake certificate received on Nov 13. Vacancy arose within 2 months. Also SC judgement has held that disqualification will go back to date of nomination. Either way, fresh elections have to be held.
