I have to admit I’m looking forward to the sanctions hearing. The incoherent frothing from when Vic gets hit for upwards of half a million in fees and sanctions will be glorious to behold. Oh, and no, he doesn’t have a chance of winning an appeal.

I think my favourite delusion is the idea that Vic somehow didn’t get “due process”. He was the one who sued. In a civil case that makes him the plaintiff and puts the onus of the burden of proof on HIM.

I asked which other lawyers he'd spoken to. I'd quite like to know. A respectful discussion with a colleague who analyzes the case differently would be interesting. So I wish he'd name these other lawyers.

I don't think it should be too hard. Causation & damages same for all ∆s (a problem for obvious reasons, but saves space). If he contests public figure (he shouldn't), that's also same for all. Same with contracts & business opportunities & conspiracy.

My impression is that most Texas lawyers who specialize in civil appellate litigation get board-certified in that area. I'm not bored enough to check how many of Ty's partners have that certification.

Define "popular." The consensus of lawyers from the outset was that Vic's case was hopeless, though some claims might get past TCPA. Then Ty failed to make the necessary record, & Vic's depo was a disaster. Both of those things remain unchanged on appeal.

So the reasons he's going to lose are basically everything that's been discussed in the about why each claimーdefamation, TI, whateverーis defective, plus the fact that he's stuck with the record he's made in district court.

The defendants on the other hand do get the benefit of due process. Which is how civil suits are designed/intended to work. Definitely a point that consistently, and endlessly amusingly, get wrong.

Thanks everyone. Life is absolute shit right now, but your kind words help. I never in my life thought that I would find solace in reading about the insanity of something like the . But coming back from the hospital for the night, it's a welcome distraction.
