Jeopardy attaches the moment a jury is sworn in to hear the case, Robert. Double jeopardy does not apply to an impeachment trial.

I think it was Ken Starr that said it's not a trial but a tribunal. THEN they all tried to say there needs to be a crime & the articles aren't a crime. AND THEN some come out & say there's a crime but not impeachable. Nancy needs to start writing legislatn against this catch 22.

The constitution says it’s a trial. Starr is wrong.

Hard for me to believe Cipollone did not recuse himself in view of fact ( if Bolton book is accurate ) he was first hand witness in May meeting Trump is alleged to have ordered Bolton to tell Ukraine no announcement of investigation into Biden no aid. Trump drop client ...

... privilege by publicly talking about meeting saying Bolton lied. He did not claim executive privilege either. Trump COULD have denied the meeting even took place - but he did not. As baffling to me as Trump lawyers telling demonstrable lies & Roberts mute. Trial or cover up?

, I'm not sure why double jeopardy wouldn't apply. Doesn't Art III, Sec 2, Par 3 say pretty clearly that an Impeachment Trial *is* a Criminal Trial (just with additional higher requirements)??

A mistrial is absolutely in order precisely because this tribunal failed the most basic requirements on many many fronts. The Senate has sole right to conduct Impeachment Trials. But it must be a trial, not a circus show/campaign ad.
