The decision says it shows good faith that the defendant found the photo online and assumed it wasn't "copyrighted" because there was no copyright notice. Guess what folks - don't do that. Assume that any photo you find online is "copyrighted".

You don't file for a trademark. The USPTO doesn't issue trademarks. You file to have your trademarks registered. The difference is important. You can have trademark rights without registration. Registration is evidence of trademark rights, and it provides enforcement advantages.
