Scientific paper: travel restrictions failed to stop the spread of H1N1. Look, I get it. Travel bans seem like an intuitive way to halt spread. But all the evidence from similar epidemics shows that the benefits are minimal and the risks are enormous.

I fundamentally disagree with this article. It doesnt address if the conditions on the island are acceptable, nor is it in line with the evidence-base & standards of least restrictive measure for quarantine. It also cites the Federal Quarantine Act which was superseded in 2016.

Australia has followed the US and has issued a travel ban on all travelers from China unless they are Australian citizens. This directly contradicts ’s PHEIC recommendations against travel restrictions. I expect will ask Australia to justify itself under Art 43.

Exactly, that demonstrates my point. That would be the sort of evidence for that individual, but the acts of one person should not be extrapolated to apply as a standard or as evidence of intent of all others/a group.

Unless there is evidence of a risk of non compliance, mandatorily detaining someone is not prima facie the least restrictive measure

The US has also announced a 14 day mandatory quarantine on any US citizen returning from Hubei province. If used, this wld likely be open to legal challenge on whether it is the least restrictive measure to protect public health & not arbitrary, oppressive & unreasonable.

Ban on foreign nationals is on “anyone considered a risk” of transmitting nCoV. Unclear how that risk is assessed: any foreign national who has been in China in the last 14 days Or an extra level of risk assessment for those who meet that travel history criteria.

The US has reportedly issued a temporary travel ban related to novel coronavirus. This appears to be a broad sweeping ban, based on travel history not nationality, and likely to be considered by (and China) an unnecessary interference with international travel and trade.

SARS occurred in 2002-2003. The international law this declaration was made under – the International Health Regulations – was revised in 2005 to add a PHEIC power. Further, novel coronaviruses (inc. SARS) were not covered by previous versions of the law.
