I believe this fact--from a detention memo in the case of Montana man Jerod Hughes filed yesterday--is new: There were Montana Proud Boys in the first wave of rioters to breach the building at "the tip of the spear" with Proud Boy Dominic Pezzola & Oath Keeper Robert Gieswein.pic.twitter.com/y7SOzSU7Zo

This new DC circuit ruling in the case of Eric "Zip Tie Guy" Munchel is gonna be oft-quoted. It strikes at the heart of tensions in the Capitol inquiry. While it's clear that cop assaulters, vandals & preplanners are guilty of serious crime, what about those who merely went in?pic.twitter.com/m7OhUzpxL1

The ruling, which sent the issue of bail for Munchel (& his mom) back to the district court for more argument acknowledges the seriousness of Jan. 6 but wants "the facts & circumstances of each case" to be fully and fairly heard.pic.twitter.com/2JrJ99vMmi

And just like that: the circuit's decision in Munchel is the very first thing discussed at a bail hearing that just started for accused Oath Keeper defendant Connie Meggs.

One thing's for sure: meting out individualized justice for a mob activity like the riot at the Capitol is and will remain a tough task. Can defendants in a mob be held accountable for the actions of those 5 feet away? 10 feet? Or not at all? Judges are trying to figure it out.

DECISION: Judge Amit Mehta, for instance, has just released accused Oath Keeper Donovan Crowl--the second Oath Keeper defendant freed pretrial today. Judge Mehta ruled that there wasn't enough evidence that Crowl had committed violence at the Capitol or was a danger to community.

Prosecutors say that more than an hour after the Capitol was breached, NC Proud Boy leader Charles Donohoe announced over a group chat that he was regrouping w/ "a second force." But the plan was short-lived as Nat Guard and federal agents were "incoming," Donohoe wrote.pic.twitter.com/RWnA9id8ut

The new Biggs papers oppose a new govt request to jail him pretrial. Biggs' argument is that the FBI knew about his "political commentary and role in planning events" since last July. The FBI, he says, "arguably benefited" from his intel on Antifa.pic.twitter.com/HcRgvLQ3e1
