Yes they may well be - though the govt would argue the key question is current risk. Not saying you're wrong, or it isn't discriminatory, just that I have tried to run this kind of discrimination argument before and it's tough

Yes - and would have to have the resources to take the case through the Bangladeshi courts. The 'entitlement' to citizenship sounds a bit of a sham

Very difficult argument to run as courts tend to say that each case should be dealt with on its merits, and there aren't many of these.

I wonder if there is a clarity of law point here (?)

It does. And it also means you cannot know how secure your citizenship is without legal advice on arcane foreign nationality laws, and even then you may not know (given that in Begum's case different experts said different things)

Here is the judgment in the Shamima Begum case (via ). Lots in there if you are interested in Bagladeshi law - re whether Begum was made stateless by the deprivation of UK citizenship. Answer, she wasn't

A rare Declaration of Incompatibility under s.4 of the Hunan Rights Act 1998 (if it survives Appeal it would be the 28th such declaration in 20 years). It would then be a matter for Ministers or Parliament to decide how to remedy the incompatibility.

High Court today: UK bereavement benefit law is discriminatory, and incompatible with ECHR rights. No justification for stopping bereaved children benefitting from HRBSP on ground of parents' marital status

This is a non-story. Barristers must act for clients when engaged without discrimination and to the best of their abilities. That is a core principle of legal professional work. IF there is a problem here it’s that TDs can double job, not that he did his job.

I don't think I said it would have prevented Miller/Cherry! There will always be gaps, but at least there are less gaps (in theory)

Shamima Begum has lost her appeal against the Home Office’s decision to revoke her British citizenship. The court found against her on three grounds, including that she had not been unlawfully deprived of her citizenship.
