The panel did not take the more drastic step of ordering the lower court judge to certify the case for an appeal, noting circuit courts are divided on whether they have jurisdiction to do that, but they basically said the judge should do it

This is regular but the lower judge is an avid liberal and tried to block the appeal. This is the upper court “suggesting” the lower court reconsider and do their job.

This means it's now back to the district judge, and Trump can renew his argument that he should be allowed to appeal opinions denying his motions to dismiss the lawsuit. Those aren't normally appealable, but the DC Circuit said this case is special given sep of powers issues
