Baton Rouge Mayor Sharon Weston Broome currently is re-negotiating the city's contract with the police union, which expires at the end of 2017. Much of the existing contract is standard worker protection and due process stuff. But it also has some very troubling provisions. 1/7

The current contract calls for the city to “remove,” “purge” or “destroy” disciplinary records and the findings of internal affairs investigations, including investigations that confirm officer violations. 2/7

Article XI.B.2 & 3 of the contract require that “all references” to internal affairs investigations be “purged after 18 months,” whether or not the complaint is sustained. 3/7

Article IX.B.4 states that “all records will be destroyed” of investigations into sexual misconduct, sexual harassment and domestic violence, even if those allegations are validated by the investigation. 4/7

Article XX requires that “only one personnel folder on each officer” be maintained, meaning removals, purges and destruction of documents are permanent. 5/7

These provisions are not in place for any other public employee in the city or parish. They appear to call for the city to violate state public records law, which requires that all documents be maintained for all public records for a minimum of three years. 6/7

What. The. ACTUAL. F....? The only provision that should be in there regarding such records is that they BE PRESERVED FOR 10 YRS PAST THE DEATH of the employee!

Your underlined text clearly says that the records will be destroyed after 5 years, so I don't see the conflict with state law. That said, it's an egregious policy. Records alleging police misconduct should never be destroyed.

This is the part that goes beyond bad policy to constitute illegal practice. 18 months for anything not otherwise stipulated, inc. excessive force.

Thank you for taking the time to reply. I don't know why, but the first time I looked at your thread that page wasn't shown. Hopefully, aided by their transparently illegal deal, you can now get both the 18-month and the 5-year limits thrown out.
