In late stage capitalism, every major company is big enough that consumer spending will mostly not cause even a dent in their finances. The consumer has no power. And if you aren't supporting one bad company, you're supporting another.

I'm not disagreeing with the idea of TOs being worried about litigation but that's inherently tied to those who are trying to expand their scope which is what TBH, Genesis, Xanadu, etc all were doing. They choose to grow into a scope that would make this an issue.

This is why PM players got upset because they all knew that if you attempted to grow too big you'd likely draw Nintendo's attention. If that was apart of your goal, why take in the PM community in the first place????

Like I said before the goal wouldn’t be to win, it would be not to lose. Which would be done with PR in the court of public opinion more than in any legal sense. Ultimately, it would be a GOOD thing if a business stood up to Ninty and did go through with the suit.

I'm sorry, I'm not a tech savvy. I'm talking about the process of dumping a cartridge into a ROM. It has been in several lawsuits. TL;DR Nintendo is an ass but legally they can remove a tournament support and banning from use if they wish to.

Dumping a cartridge or any media for that matter onto a format later accessible has been in multiple lawsuits and has been deemed legal on multiple of those lawsuits. Keep in mind we aren't talking about redistributing, just making your own backup.
