Our amicus brief in Masterpiece Cakeshop made this precise point & reminded the Court that religious exemption arguments were used to justify refusing to serve Blacks in the 60s. The SCOTUS rejected those arguments then.

If we’re going to talk about moral culpability & harsh consequences for the transgressions of young people....frankly it’s just cruel to ignore the most obvious & truly egregious public manifestation of this phenomenon.

How can this, whatever your view, result in a full-on debate from writers in the pages of our most influential papers, w/o the need to acknowledge the devastating reality of lives stolen & shattered by a society that denies childhood to so many Black children.

Boys whose family & life circumstances have left them in tough spots making decisions too weighty for their minds & souls. They are not forgiven. I know you know this .Could you have spared ink to acknowledge them in your defense of this young man’s moral journey?

It’s this passage....Millions of Americans have now seen in which 16 year old is convicted of a crime he did not commit & sent to adult jail. You know we have a criminal justice system that does not forgive Black & Brown boys.

Rikers Island should be closed forever, but seeing abuse its power to give Paul Manafort special treatment should anger everyone. This is someone who betrayed the country for his own profit and the President’s, and the government does this.

Before lunch a white woman on the jury seemed to be leaning w/the two Black jurors in favor of manslaughter. At lunch all the white jurors ate together. “When they returned from lunch, all ten white jurors wanted to vote for second-degree murder; there was no convincing them..”

How do non-unanimous juries disempower Black jurors? “Bobby and I saw from the beginning that our vote wasn’t going to matter. We were outnumbered,” said one of two Black jurors serving on a jury w ten whites in a murder case involving a 20 yr old Black defendant.

Today we filed an amicus brief in SCOTUS in Ramos v Louisiana. In 2018 La. voters overturned the use of nonunanimous jury verdicts. But there’s no retroactive relief for those convicted under this system which was created by the state in 1898 to disempower Black jurors.

Public defenders are the salt of our justice system. Without your work, the American criminal justice system would collapse into complete ignominy.
