We have laws against battery. And we have laws shielding police officers from liability for battery when the force used was necessary (i.e., not excessive). The jury didn’t use the police privilege to protect the officer. They found no battery occurred.

Jury verdict in Zebroski v. City of Portland: no battery. “No battery” is shocking. A Portland police officer tackled, dragged, and broke our client’s nose. The jury did not even reach the question of whether that force was excessive, which is necessary for police liability.
