Never underline at all unless you're using an old typewriter that has no Italic option.

Italicize unless you’re being forced to use a monospaced font. If the Court wants it to look like a typewriter, oblige them.

I underline in Alabama appellate courts, because they require Courier New and, well, fine. I’ll make it look like it was written on a typewriter if that’s what you want.

I agree with this. If you’re using Courier New and are therefore going for that typewriter look, then, for Pete’s sake, go all the way. (I even kind of like one-inch indents to start paragraphs, for a really old-school touch.)

Italics. In local briefs I also use bold type for case name.

If you’re in a jurisdiction that doesn’t require 13pitch courier new, it’s a great choice.
