Due to a redaction error in one of the memos, you can read that Comey confirmed Flynn was under surveillance, which suggests that Priebus asked the FBI to lie to the public, which the FBI refused to do. Lying to the public, unlike lying to the FBI, is usually not a crime.

Priebus-Comey talk on whether Flynn was under surveillance came about a week before Priebus asked the FBI to knock down stories about communications bw Trump associates and Russians. FBI declined to do so.

Just 13 days after Yates warned WH that Flynn could be subject to Russian blackmail, Priebus asked Comey if FBI had a FISA warrant on Flynn, prompting Comey to urge WH to use proper channels. Then almost a week later, Trump tells Comey, “I hope you can let this go,” re Flynn
